Terms of Use and Licensing

1. Provider and scope

Optio is a browser extension for the browser game Gladiatus, provided by the operator named in the imprint, based in Switzerland (“we”). These terms apply to the use of Optio and its licenses. Optio is an independent fan project and not affiliated with or endorsed by Gameforge.

2. Purchase through Creem

Licenses are sold through Creem (creem.io), which acts as reseller and Merchant of Record. Your purchase contract, payment, invoice and VAT are handled by Creem under Creem’s terms. We provide the license and the software.

3. Free trial

Each game account (game server + character) can use a free 7-day trial with all features (Full) once. No payment details are required and the trial ends automatically.

4. License

• A license is bound to one game account at a time and can be used on any number of devices and browsers.
• It can be moved to another game account by entering the license key there, at most once every 24 hours. The previous account loses the license at its next check (within 6 hours).
• Essential includes expeditions, dungeon, arena, Circus Turma, healing, hide gold, all quality-of-life features and statistics. Full includes all features of Optio.

5. Subscription, term and cancellation

• Licenses are subscriptions with a term of 1, 3, 6 or 12 months. They renew automatically for the same term unless cancelled.
• You can cancel at any time via the customer portal linked in your Creem e-mail. The license remains valid until the end of the paid term.
• If you buy another plan while a subscription is running, the running subscription is cancelled at the end of its paid term. No paid time is lost: the terms are added one after another.

6. Prices

The prices shown in the extension and on this website apply, plus VAT where applicable. VAT is calculated by Creem at checkout based on your country.

7. Refunds

If you are not satisfied, we refund the first payment of a subscription on request within 3 days of the purchase – just write to optio-qol@proton.me with your license key or game account. Renewals are not refunded; you can cancel at any time instead (section 5). With a refund, the license ends immediately. Statutory rights, in particular any right of withdrawal you may have towards Creem as the seller, remain unaffected.

8. Features and availability

• Optio depends on the game. Game updates may temporarily impair features; we fix such issues with reasonable effort but cannot guarantee uninterrupted availability.
• We may change or remove individual features, e.g. if the game changes or a feature no longer works reliably. The scope of Essential and Full described in section 4 remains.
• If the license server is temporarily unreachable, Optio keeps working with the last confirmed license for up to 3 days.

9. Use at your own risk

Optio automates actions in Gladiatus. The rules of the game operator may restrict the use of such tools. You are responsible for complying with the rules of your game server. We are not liable for measures taken by the game operator, such as warnings or suspensions of your game account.

10. Liability

We are liable for damage caused intentionally or through gross negligence. Liability for slight negligence is excluded to the extent permitted by law. Mandatory liability, in particular for personal injury and under the Swiss Product Liability Act, remains unaffected.

11. Final provisions

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, the mandatory consumer protection rules of the country in which you live remain unaffected. Should individual provisions be invalid, the remaining provisions remain valid.

Nutzungs- und Lizenzbedingungen (AGB)

1. Anbieter und Geltungsbereich

Optio ist eine Browser-Erweiterung für das Browserspiel Gladiatus, angeboten von dem im Impressum genannten Betreiber mit Sitz in der Schweiz („wir“). Diese Bedingungen gelten für die Nutzung von Optio und seine Lizenzen. Optio ist ein unabhängiges Fanprojekt und steht in keiner Verbindung zu Gameforge.

2. Kauf über Creem

Lizenzen werden über Creem (creem.io) verkauft, das als Wiederverkäufer und Merchant of Record handelt. Kaufvertrag, Zahlung, Rechnung und Umsatzsteuer wickelt Creem nach seinen eigenen Bedingungen ab. Wir stellen die Lizenz und die Software bereit.

3. Testlizenz

Jedes Spielkonto (Spielserver + Charakter) kann einmal eine kostenlose Testlizenz über 7 Tage mit allen Funktionen (Full) nutzen. Zahlungsdaten sind dafür nicht nötig; die Testlizenz endet von selbst.

4. Lizenz

• Eine Lizenz gilt jeweils für ein Spielkonto und lässt sich auf beliebig vielen Geräten und Browsern nutzen.
• Sie lässt sich auf ein anderes Spielkonto übertragen, indem dort der Lizenzschlüssel eingegeben wird – höchstens alle 24 Stunden. Das bisherige Konto verliert die Lizenz bei seiner nächsten Prüfung (innerhalb von 6 Stunden).
• Essential umfasst Expeditionen, Dungeon, Arena, Circus Turma, Heilung, Gold verstecken, alle QoL-Features und die Statistik. Full umfasst alle Funktionen von Optio.

5. Abo, Laufzeit und Kündigung

• Lizenzen sind Abos mit einer Laufzeit von 1, 3, 6 oder 12 Monaten. Sie verlängern sich automatisch um dieselbe Laufzeit, wenn sie nicht gekündigt werden.
• Kündigen kannst du jederzeit über das Kundenportal, das in deiner E-Mail von Creem verlinkt ist. Die Lizenz gilt bis zum Ende der bezahlten Zeit.
• Kaufst du ein anderes Lizenzmodell, während ein Abo läuft, wird das laufende Abo zum Ende seiner bezahlten Zeit gekündigt. Keine bezahlte Zeit geht verloren: die Laufzeiten werden hintereinandergehängt.

6. Preise

Es gelten die in der Erweiterung und auf dieser Website angezeigten Preise zuzüglich Umsatzsteuer, soweit sie anfällt. Die Umsatzsteuer berechnet Creem beim Bezahlen anhand deines Landes.

7. Erstattung

Bist du nicht zufrieden, erstatten wir auf Anfrage die erste Zahlung eines Abos innerhalb von 3 Tagen nach dem Kauf – schreib einfach an optio-qol@proton.me mit deinem Lizenzschlüssel oder Spielkonto. Verlängerungen werden nicht erstattet; stattdessen kannst du jederzeit kündigen (Abschnitt 5). Mit der Erstattung endet die Lizenz sofort. Gesetzliche Rechte, insbesondere ein etwaiges Widerrufsrecht gegenüber Creem als Verkäufer, bleiben unberührt.

8. Funktionen und Verfügbarkeit

• Optio hängt vom Spiel ab. Updates des Spiels können Funktionen vorübergehend beeinträchtigen; wir beheben das mit angemessenem Aufwand, eine ununterbrochene Verfügbarkeit können wir aber nicht zusagen.
• Einzelne Funktionen können wir ändern oder entfernen, etwa wenn sich das Spiel ändert oder eine Funktion nicht mehr zuverlässig arbeitet. Der in Abschnitt 4 beschriebene Umfang von Essential und Full bleibt erhalten.
• Ist der Lizenzserver vorübergehend nicht erreichbar, arbeitet Optio mit der zuletzt bestätigten Lizenz bis zu 3 Tage weiter.

9. Nutzung auf eigene Verantwortung

Optio führt Aktionen in Gladiatus automatisch aus. Die Regeln des Spielbetreibers können die Nutzung solcher Werkzeuge einschränken. Für die Einhaltung der Regeln deines Spielservers bist du selbst verantwortlich. Für Maßnahmen des Spielbetreibers, etwa Verwarnungen oder Sperren deines Spielkontos, haften wir nicht.

10. Haftung

Wir haften für Schäden, die wir vorsätzlich oder grobfahrlässig verursachen. Die Haftung für leichte Fahrlässigkeit ist ausgeschlossen, soweit das Gesetz es zulässt. Zwingende Haftung, insbesondere für Personenschäden und nach dem Produktehaftpflichtgesetz, bleibt vorbehalten.

11. Schlussbestimmungen

Es gilt Schweizer Recht unter Ausschluss des UN-Kaufrechts (CISG). Bist du Verbraucher, bleiben die zwingenden Verbraucherschutzvorschriften des Landes, in dem du lebst, unberührt. Sollten einzelne Bestimmungen unwirksam sein, bleiben die übrigen wirksam.
